These Terms of Service (the “Terms”) apply to the Ignite + Aliign website (www.ignitealiign.com), mobile application, studio facilities and all products or services (collectively, the “Services”) offered now or in the future by Vitoriium Wellness Private Limited (“Ignite + Aliign”, “we”, “our”, “us”). By accessing or using any part of the Services, booking or attending a class, or purchasing a membership, you (“Member”, “you”, “your”) acknowledge that you have read and understand these Terms and agree to be legally bound by them.

1. CONVENIENCE & INFORMATION ONLY
The Website and app are provided for your convenience and information. While we endeavour to keep content accurate and up‑to‑date, we make no warranties that the content is complete, error‑free or will remain uninterrupted.

2. SITE USE & CONTENT
You may view or print pages from the Website/app for personal, non‑commercial use only. You may not otherwise copy, distribute, reproduce or publish any portion of the Website without prior written consent. We reserve the right to modify, suspend or discontinue the Website, the app or any Service, at any time without notice.

3. USER ACCOUNT, PASSWORD & SECURITY
Certain features require a user account protected by a password. You agree to: (i) provide true, current and complete information; (ii) keep your login credentials confidential; (iii) notify us immediately of unauthorised use; and (iv) log out at the end of each session. Accounts and log‑ins are non‑transferable.

4. CLASSES — DISCLAIMERS; MEDICAL INFORMATION; INDEMNIFICATION & RELEASES; PERSONAL PROPERTY; LIMITATION OF LIABILITY
(a) No Warranties: Classes and related content are provided “as is” and “as available”, without warranties of any kind. We do not guarantee you will be able to book classes at times of your choosing.
(b) Medical Information: Yoga, especially in a heated environment of 30–42 °C and high humidity, carries inherent risks. Consult a qualified physician before beginning any programme. Our instructors are not medical professionals. Participation is voluntary and at your own risk.
(c) Indemnity & Release: By attending any class or using the Services you assume all risks of injury (including serious injury or death) and agree to release and hold harmless Ignite + Aliign, its officers, employees and agents from any liability arising out of your participation.
(d) Personal Property: All personal belongings are brought onto the premises at your sole risk. We are not responsible for loss, theft or damage.
(e) Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special or consequential damages. Our aggregate liability is limited to the amount you paid for the affected Service.

5. PRICING, PURCHASE & EXPIRATION
5.1 All prices are stated in Indian Rupees and are exclusive of GST unless otherwise noted.
5.2 Single classes, class‑packs, introductory offers, memberships, workshops, events and beverages are non‑refundable and non‑transferable except as required by law.
5.3 Class‑packs and promotional passes have explicit expiry dates shown at purchase; no extensions are permitted.
5.4 Fixed‑term unlimited memberships commence on the purchase date, run for the stated term and do not auto‑renew. To continue after expiry you must purchase a new plan at prevailing rates.
5.5 A one‑time joining fee may apply to certain plans. Dishonoured payments may attract only the bank’s administrative charges.

6. BOOKING, CANCELLATION & NO‑SHOWS
6.1 All class reservations and cancellations must be made through the Ignite + Aliign app. Each class lists its own booking window and cancellation cut‑off.
6.2 Unless the class specifies otherwise, you may cancel without penalty anytime before the cut‑off displayed in the app and the credit will be reinstated.
6.3 Members are permitted up to three (3) late‑cancellations or no‑shows in any rolling 30‑day period; additional incidents may incur penalties, forfeiture of credits, suspension of booking privileges or fees, all at the Studio’s discretion. Penalties may be waived entirely at our sole discretion.
6.4 Wait‑list: If a space opens up you will be auto‑enrolled and normal cancellation rules apply.
6.5 Schedule & Instructor Changes: The posted timetable and teacher line‑up are indicative only; we may change or cancel classes, instructors or timings at any time without notice.

7. MEMBERSHIP FREEZE & SUSPENSION
7.1 Unlimited memberships of one (1) month or longer may be suspended once per contractual year for 8–30 consecutive days upon payment of a ₹1,500 + GST freeze fee.
7.2 Medical freeze of up to six (6) months (nine (9) months for pregnancy) may be granted on submission of a doctor’s certificate. Class‑packs and promotional passes are not eligible for freezes.

8. STUDIO ETIQUETTE & ACCESS
• Arrive at least 10 minutes before class; doors lock 5 minutes after start.
• No shoes, glass containers, personal mats (unless authorised), phones or smart devices are allowed in the yoga room.
• Members must be 14 years or older. Ages 14‑17 require a parent/guardian consent form and may attend only classes designated for minors.
• Outside food or alcoholic beverages are prohibited; reusable water bottles are encouraged.
• We reserve the Right of Admission & Subscription. We may refuse service, cancel packs or terminate memberships at any time; refunds (full or partial) are entirely at our discretion.

9. NON‑ALCOHOLIC BEVERAGE SERVICE
We may offer smoothies, cold‑pressed juices, electrolyte drinks and other non‑alcoholic refreshments prepared in a facility that handles allergens. Please disclose allergies; consumption is at your own risk. Beverages must stay in designated lounge areas.

10. TERMINATION OF SERVICE; RETURN POLICY
10.1 We may terminate your account, membership or right to access secured portions of the Website or studio without notice for conduct we believe violates these Terms or is harmful to other Members or staff.
10.2 Except as required by the Consumer Protection Act 2019, all purchases are final and non‑refundable. If we cancel a class, pack or membership for our own reasons, we may offer a replacement credit or pro‑rated refund at our discretion.

11. PRIVACY & DATA PROTECTION
We process personal data in accordance with the Digital Personal Data Protection Act 2023 and our Privacy Policy (available on the Website). CCTV operates in public areas for security purposes.

12. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of India. Any dispute shall first be resolved amicably within 30 days; failing which, the matter will be referred to arbitration under the Arbitration & Conciliation Act 1996 with a sole arbitrator seated in Bengaluru, Karnataka. Subject to the foregoing, Bengaluru courts will have exclusive jurisdiction.

13. CHANGES TO TERMS
We may update these Terms at any time by posting the revised version on the Website and app. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

14. SEVERABILITY
If any provision is held invalid, the remaining provisions shall remain in full force. Our failure to enforce any provision is not a waiver.
